Fat PS3 Owners Can Claim $55 Compensation From Sony
Who remembers when Sony removed support for running linux on the original Fat PS3? It seems like a very long time ago and it turns out it is looking back through articles here on Geek.com. Ifirst wrote about it in March 2010, and owners were so upset they decided to sue Sony.
The OtherOS functionality of the original PS3 meant you could install a flavor of Linux and turn your games console into a PC. However, on April 1, 2010 Sony released a new firmware update (3.2.1) that removed the feature. At the time, SCEA Senior Director of Corporate Communication & Social media Patrick Seybold explained the decision had been taken to ensure a more secure system.
Less than a month later and a class action lawsuit had been filed by Anthony Ventura seeking $5 million compensation. The lawsuit wasdismissed in 2011 and then revived on appeal in 2014. Two years on and Sony has finally decided to settle, and it could cost them a small fortune depending on how good Fat PS3 owners are at keeping records.
If you live in the US and purchased a Fat PS3 between November 1, 2006 and April 1, 2010 then you can claim $55 compensation from Sony. However, in order to qualify you must produce proof of purchase and proof of use of the OtherOS feature. Alternatively, you can provide proof of purchase and attest that you intended to use the OtherOS feature and receive $9 compensation.
Proving you owned a Fat PS3 between the specified dates is pretty simple. Just dig out your receipt, a bank or credit card statement with the purchase listed, or some other documentation showing proof of purchase. Proving you used Linux on your PS3 is more tricky, though. That requires a screenshot of Linux running on your PS3, proof of purchase of Linux, or some documentation that clearly shows it was being used. You’ve got until December 7, 2016 to submit your claim with the required proof on the OtherOS Settlement website .
The actual settlement won’t be approved until January 24, 2017 and then the judge may decide not to allow it to go ahead. However, if it does and your claim is approved, cash payments will be sent out approximately 40 days later, so you’ll have your cash in March 2017.
I can see there being a lot of rejections based on the Linux use evidence not being good enough. I can also see a lot of Photoshopping happening in the coming weeks attempting to mock up the perfect Linux on PS3 screenshot to accompany a Fat PS3 receipt.
